If you decide to subscribe to our newsletter, schedule a meeting to meet us online or to apply for a job, we will collect and process the personal data you provide us for one of the purposes above.

All the data provided will be collected and processed in accordance with the EU – Regulation no. 679/2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).

What kind of personal data do we collect and process and what is the purpose thereof?

Depending on the purpose you provide us with your personal data, we collect and process the following information:

  • if you decide to subscribe to our newsletter, we will collect and process your email address, in order to be able to send you the newsletter;
  • if you decide to schedule a meeting through our “meet us online” section, we will collect and process your first name and last name, your email address, your company name (if the case), your phone number and any other personal information you provide in the brief description of the matter for which you want to meet with us;
  • if you decide to apply for a position within LLA, we will collect and process your name, your email address, your phone number and any other personal information you provide us in your CV. 

Which is the legal basis for the collection and processing of the personal data?

The legal basis we rely on depends on the purpose of the collection and processing of the personal data, as follows:

  • we rely on your consent for collecting and processing your email address in order to send you our newsletter (art. 6 par. 1 letter a of the GDPR);
  • we need all the personal data required in the “meet us online” section in order to schedule the meeting and take the necessary steps for starting a collaboration and help you with your request (art. 6 par. 1 letter b of the GDPR) and we will also request your consent for this purpose (art. 6 par. 1 letter a of the GDPR);
  • we need all the personal data required in the “join us” section in order to evaluate the possibility of you becoming part of our team (art. 6 par. 1 letter b of the GDPR) and we will also request your consent for this purpose (art. 6 par. 1 letter a of the GDPR).

Where do we store the personal data, who has access to it and for how long do we keep it?

We store the personal data on …, and we keep it for as long as it is needed depending on the purpose we collected or processed it. If we rely on your consent (for the newsletter), we will keep it until you withdraw your consent by unsubscribing from the newsletter.

All of our internal and external collaborators and or partners will have access to the personal data.

What are your rights?

The right to be informed and to access the data

You have the right to be informed regarding the collection and processing of your personal data and to obtain from us, on request, access to the data and confirmation as to whether or not your personal data is being processed, as well as the following information:

  • the purpose for which the personal data is collected and processed;
  • the categories of personal data that are collected and processed and the legal basis thereof;
  • the period for which the personal data will be stored, or if that is not possible, the criteria used to determine that period;
  • the recipients or the categories of recipients of the personal data, if the case;
  • the existence of the right to request access to the personal data;
  • the existence of the right to request rectification or erasure of the personal data, restriction of the processing activity or to object to the processing activity;
  • the existence of the right to data portability;
  • the existence of the right to lodge a complaint with the competent supervisory authority in Romania or with the competent judicial court;
  • information regarding whether the personal data is used for any automatic decision-making process, including profiling and all the details thereof;
  • whether we intend to transfer the personal data to a third country or international organization and the existence of the right to be informed regarding appropriate or suitable safeguards;
  • whether providing the personal data is due to a statutory or contractual requirement or a requirement necessary to enter into a contract;
  • whether you have an obligation to provide the personal data and if there are any possible consequences of failure to provide such data, if the case.

The right to rectification

You have the right to obtain from us without undue delay the rectification or the completion of any inaccurate personal data.

The right to be forgotten

You have the right to request the erasure of your personal data, and we will do so if one of the following applies:

  • the personal data is no longer necessary in relation to the purposes for which they were collected and processed;
  • you withdraw your consent and there is no other legal basis on which we rely for continuing to process your personal data;
  • you object to the processing of your personal data for specific reasons and there are no overriding legitimate grounds for us to continue to process your personal data or the only purpose of the processing activity is direct marketing;
  • the personal data has been unlawfully processed;
  • the personal data have to be erased for compliance with a legal obligation prescribed either by the law of the European Union or of a Member State to which we are subject to;
  • the personal data has been collected for the purpose of offering informational services.

The right to request the restriction of the processing activity

You have the right to obtain the restriction of the processing activity, and we will do so if one of the following applies:

  • if you challenge the accuracy of your personal data, in which case the processing will be restricted for the period necessary in order for usto verify the accuracy thereof;
  • the processing is unlawful, and you do not agree to the erasure of your personal data and request the restriction of its use instead;
  • we no longer need your personal data, but you need it in order to exercise, defend or establish some specific legal claims;
  • you objected to the processing activity, in which case the processing activity will be restricted until weestablish if our legitimate grounds for the processing override your reasons for objecting to the processing activity.  

The right to object to the processing of the data

You have the right to object to the processing of your personal data, if one of the following situations applies:

  • if the legal basis for the processing activity is either for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller or for the purposes of the legitimate interests pursued by the controller or by a third party (none of which applies in our case), you can object to the processing of your personal data and we will need to accept your request, except for the case where we demonstrate compelling legitimate grounds for the processing, which override  your interests, rights and freedoms or if the processing is necessary for the exercising, defending or establishing of legal claims;
  • if we processes your personal data for direct marketing purposes (which does not apply in our case).

The right to data portability

You have the right to receive your personal data that you provide us in a structured, commonly used, and machine-readable format and/or to ask us to transfer such personal data to another controller, if this is technically feasible.

The request for data portability does not automatically trigger the erasure of the data from our systems and does not affect the initial storage period applicable for the transmitted personal data.

The right to not be subject to a decision based solely on automated processing

You have the right to not be subject to a decision based solely on automated processing, including profiling, which produces legal effects or similarly significantly affects you.

According to the GDPR, you can be submitted to a decision-making process as the one referred above only in one of the following situations:

  • it is necessary for entering into a contract with us or for the execution of a contract you concluded with us;
  • it is authorized by Union or Romanian Law and which also lays down suitable measures to safeguard your rights and freedoms and legitimate interests;
  • it is based on your explicit consent.

The right to withdraw your consent

You have the right to withdraw your consent at any time. The consent can be withdrawn either by clicking the „unsubscribe” button in the newsletter you receive or by sending an email with the text „unsubscribe” to office@lla.ro.

The withdrawal of the consent does not affect the lawfulness of the data processed based on the consent before the withdrawal.

The right to an effective judicial remedy

You have the right to lodge a claim in front of the competent judicial courts if you consider that your rights under the GPDR have been infringed as a result of the processing of your personal data in non-compliance with the GDPR.

Proceedings against us shall be brought before the Romanian courts, the Member State where we have our establishment.

Proceedings against the supervisory authority shall be brought before the courts of the Member State where the supervisory authority is established.

Procedural aspects for the exercise of the abovementioned rights

In all the cases where you wish to exercise one of the rights referred to above, you need to submit your request, in writing, with date and signature or in electronic format, using the following contact details:

If you submit the request by electronic means, the information shall be provided by electronic means, unless you request otherwise.

We will provide you the response within one month of receipt of the request. This period may be extended by two further months where necessary, considering the complexity and number of the requests. We will inform you of any such extension within one month of receipt of the request, together with the reasons for the delay.

If the requests are unfounded or excessive, in particular because of their repetitive character, we may either:

  • charge a reasonable fee considering the administrative costs of providing the information or communication or taking the action requested; or
  • refuse to act on the request.
